X-ray Tube Warranty
The
Superior X-ray Tube Company warrants its x-ray
tubes to be free of defects in material
or workmanship which will reduce their
normal operating life when operated within their rated parameters.
This
warranty is a pro-rated 15 month warranty. Claims must be
made within 15 months of the invoice date for the tube. The
Superior X-ray Tube Company will decide whether a replacement tube
or a pro-rated credit allowance will be issued
after the tube has been returned, analyzed, and it is determined
that the tube has failed and that the failure is
not the result of abuse, misuse, or operation outside of the
rated parameters for the tube. The Superior X-ray Tube Company
reserves the sole right to determine whether the tube has
failed and whether that failure is
due to defects in material or workmanship.
Upon customer request, the Superior X-ray Tube Company will
provide a written report to the customer summarizing the
results of the analysis. If the Superior X-ray Tube
Company rules that a tube is not covered by
warranty, the customer may request that the tube be returned for
their own analysis.
Warranty Limitation
Except as
specifically provided for under “Warranty”, the Superior X-ray Tube
Company makes no other warranties, express or implied,
including but not limited to any implied
warranties of fitness for a particular purpose
or implied warranties of merchantability. The Superior
X-ray Tube Company’s liability under its express warranty
shall be limited to tube replacement or a credit
allowance; and the Superior X-ray Tube Company shall not be
liable for any incidental or consequential
damages as a result of any breach of warranty. All
liability of the Superior X-ray Tube Company for incidental or
consequential damages being hereby expressly disclaimed and excluded.
